Primary Objective:
The successful candidate is required to work in an integrated Client
and Project Management Consultant (PMC) team, undertaking Pre-Contract
Development and Post-Contract Administration activities for
Engineering, Procurement and Construction (EPC) Contracts for a 1 300
km gas pipeline system and associated works. Experience in pipelines,
compressor stations, metering stations and SCADA and
telecommunications works together with related services would be an
advantage. The contracts use Client standard contract forms adapted
for Kazakhstan contract conditions, often on a Lump-Sum Turn-Key
(LSTK) basis.
Specific Responsibilities Applicable to Position:
At pre-contract stage, the work involves the review of the Joint
Venture Client’s standard contract conditions and the associated bid
documentation and if necessary, the proposal of alternative
text/clauses or comments to these conditions and bid documents,
including reviews of issues associated with legal matters, risk
management, tax and accounting, cost and scheduling, engineering and
construction personnel as conditions precedent to submitting bid
documentation to the Client for final approval. Thereafter, the work
entails coordinating the preparation and submission of the
invitation-to-bid (ITB) packages to bidders, including processing
clarifications from bidders, preparation of bid evaluation programmes,
contractual evaluation of bids and negotiation with bidders, leading
to contract preparation and the award of contracts.
At post-award stage, the work includes conducting kick – off meetings,
administration of assigned contracts to ensure compliance with
contractual terms and conditions, coordinating all contract submittals
and correspondence, preparation of amendments to contracts,
contractual letters for Client, contract interpretation as necessary,
preparation and processing of Change Orders, assisting in the
resolution of claims and the eventual close out together with
constructive feedback on Lessons Learned from the Contract
Development and Administration activities.
Qualifications and Experience
•Higher Education Degree (in Legal or Engineering Discipline or
similar) is mandatory, preferably including
education in Western institution of higher learning.
•Fluent knowledge of English and Russian languages is required.
•Knowledge and experience in international contractual and legal
practices related to development
and execution EPC Contracts
•Familiarity with Kazakhstan Law and Legislation in the area of
Commercial Contracts.
•Minimum of 5 years of contracts experience, preferably in oil and gas sector.
•Experience in pre-award activities, involving qualification of
Bidders, would be preferable
•Contracts Development Experience, drafting ITB’s, utilizing differing
forms of contract and pricing formats, particularly EPC scope and Lump
Sum conditions.
•Development of related contract and commercial procedures.
•Contracts Management experience and hands-on Contract Administration
experience, including training/mentoring of local staff, where
applicable.
•Experience in major Onshore or Offshore Oil & Gas Projects, or for
Major Oil Company or EPC Contractor would be a plus.
•Advantageous to have experience in Pipelines, Gas-Turbine
Compressors and Power Generation, particularly in respect of
Compressor or Power Stations.
•Experience in dealing with Contracts in the CIS (e.g., Republic of
Kazakhstan or Russian Federation) is preferred.
